LSRP Program in NJ

The LSRP Program is a key provision of New Jersey’s Site Remediation Reform Act (SRRA), which became effective on May 7, 2009 and was amended in 2019. Created to resolve the backlog of over 20,000 environmental remediation cases in New Jersey, the program was modeled after a similar program in Massachusetts and designed to streamline and expedite the remediation process in New Jersey.

With the LSRP Program, remediation evolves from the traditional process. Professional judgment is used in conjunction with environmental regulations for remedial decisions and approvals that are protective of public health and safety and the environment.

Did You Know?

• All existing site remediation cases in New Jersey were required to hire an LSRP by May 7, 2012.
• Cases that originated prior to May 1999 were required to complete Remedial Investigation by May 2014.
• An LSRP issues a Response Action Outcome (RAO), which is equivalent to a No Further Action (NFA) letter issued by NJDEP.
• LSRPs are bound by a strict code of ethics and are overseen by a Licensing Board.
• An affirmative obligation exists to remediate any discharge subject to New Jersey’s Spill Compensation and Control Act.
• Remedial Action Permits are required for sites with institutional and engineering controls.
• Key environmental regulations include the Administrative Requirements for the Remediation of Contaminated Sites (ARRCS), Technical Requirements for Site Remediation (TRSR), and guidance documents.
• The regulations have timeframes for the completion of Remedial Investigations and Remedial Actions.
